What am I responsible for?
As a Breely user, you are responsible for ensuring that your email practices comply with our anti-spam requirements as well as any laws that apply to your business and your recipients.
Here’s a summary of your obligations:
Follow Breely’s anti-spam requirements. Our standards align with the U.S. CAN-SPAM Act.
Comply with local laws. You are responsible for understanding and following any additional anti-spam or data protection regulations in the country where your business operates.
Respect recipient laws. If your contacts or customers are located in other countries, you must also comply with the applicable anti-spam and data protection laws in those regions.
Breely Requirements
Breely is based in the United States, and our email platform complies with the CAN-SPAM Act, the U.S. law governing promotional emails. To further protect our service, our users, and their contacts, we’ve put additional requirements in place. Here’s what you need to know:
Agree to our Terms of Use. All email senders must follow Breely’s Terms.
Be transparent about your contacts. You must be able to tell us where your contacts came from.
Always include an unsubscribe link. Every email campaign sent through Breely must provide recipients with a clear way to opt out.
Include your business information. Every promotional email must contain valid contact details, including a physical mailing address or P.O. Box where you can receive mail.
Use accurate information. You may not falsify sender details, subject lines, or other identifying information.
Follow integration rules. If you connect Breely with an e-commerce platform or other integration, you are also bound by that platform’s terms of use.
Comply with CAN-SPAM. All email sent through Breely must follow the requirements of the CAN-SPAM Act, even if your business operates outside the United States.
International Requirements
Email laws differ from country to country, and your obligations may depend on both where your business is located and where your contacts live.
It is your responsibility to understand and comply with any additional laws that apply to you or the messages you send through Breely. In many cases, this may include data protection or privacy regulations in addition to anti-spam rules.
If your business operates outside the United States, or if you send emails to international contacts, you’ll need to confirm what laws apply before using Breely to send campaigns.
